We do, however, retain the right to elect to remove any material that we, in our sole discretion, consider unlawful, infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable. Violations of system or network security, including but not limited to hacking and the introduction of viruses, malware, spyware, or other contaminating or destructive feature, are prohibited and may result in criminal and/or civil liability. The Museum will investigate incidents involving such violations and may involve and cooperate with law enforcement if a criminal violation is suspected. We reserve the right to refuse service and/or access, onsite and online, to any individual who disregards these Terms of Use, violates other Museum policies, or acts disrespectfully toward the Museum’s guests, staff, exhibits, or property.

Our website may provide links to websites maintained by others. The Museum does not endorse or take responsibility for the content, advertising, privacy practices, availability, or any other aspect of any external website (websites that do not begin with www.cdm.org). Under no circumstances shall the Museum be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your accessing or using an external website.

Intellectual Property

Our digital assets, including but not limited to text, photographs, and other materials available through our website, are protected by copyright and trademark laws, and they are the property of the Museum. Unless otherwise stated, you may print or download the Museum’s digital assets for informational, educational, and other noncommercial purposes. You may not reproduce, record, publish, modify, or distribute any of the Museum’s digital assets for commercial purposes without prior written consent from the Museum. Arbitration

Any controversy or claim arising out of or relating to these Terms of Use shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. You agree that you will seek relief only on an individual basis, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitration shall be conducted in Santa Clara County, California, and judgment on the arbitration award may be entered by any court of competent jurisdiction.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.

Waiver and Severability

No waiver of any of these Terms of Use by the Museum shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of the Museum to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

We reserve the right to modify these Terms of Use at any time. You should frequently check these Terms of Use for changes. By using this website after we post any changes to these Terms of Use, you agree to accept those changes, whether or not you have reviewed them. If at any time you choose not to accept these Terms of Use, please do not use our website.
